Hari Krishna Mandir Trust Vs State of Maharashtra

The Hon’ble Supreme Court of India has held that Article 21 imposes on the state an obligation to safeguard the life of every person. The state-run hospitals and the medical officers employed therein are duty-bound to extend medical assistance for preserving human life. Violation of this duty amounts to a violation of article 21. Therefore, in cases of Public health hazard, the government can be compelled to ensure adequate medical supplies to tackle Covid 19, including arrangements of Hospital beds, oxygen supply, medicines, and other medical assistance.
